What the Panama Qualified Investor Visa is and who the property route suits

If many investors are looking at the country of the canal, that's thanks to the Panama Qualified Investor Visa, one of the most cost-effective and flexible residency options worldwide. With the real estate route starting at $300,000, it stipulates a minimum holding period of five years. If the foreigner decides to sell after this period, they can continue to be residents in Panama.

Real estate is the most convenient route of all three, which are: real estate (minimum USD300,000), stock market securities (minimum $500,000), and fixed-term deposit (minimum USD 750,000). The following piece is fully dedicated to the property route, its main advantages and characteristics.

Permanent residency on approval: why this matters more than it sounds

Taking a bird’s-eye look across similar programs immediately highlights the advantages of the country. Its investor visa grants immediate permanent residency for $300,000, as stipulated by Executive Decree No. 193, while the Portugal golden visa grants residency for two years for a € 500,000 investment in (mostly Portugal-based) investment funds. Similar approaches can be seen in Greece and the EAU, yet none of them compares to Panama in terms of costs and flexibility. 


Where the property route sits among Panama's residency programs

According to Executive Decree No. 193, the Qualified Investor Visa is available in exchange for an economic contribution. This can be $750,000 in a fixed-term deposit in a local bank account, which must be held for at least five years. At the moment of application, individuals must submit a certificate from the bank demonstrating the existence of the deposit and stating all its details. Also, they require an authenticated copy of the deposit certificate.

Who qualifies, and who should look at a different program

One of the most positive aspects about this visa is its complete eligibility, welcoming citizens from almost every part of the world to become residents in Panama.

In comparison with other programs, this is the most open when it comes to eligibility. While everybody qualifies, other programs may be better suited for specific cases. If they have a lifetime pension, for example, Pensionado visa is the most cost-effective route, while citizens of the US, Canada, and the UK are eligible for Friendly Nations

From the table above, it's easy to understand how the minimum investment thresholds for permanent residency are $300,000 and 350,000 (Qualified Investor and Reforestation). There are higher investment thresholds in the investor visa for those specifically interested in a more liquid investment and also lower options for a 2-year residency. The latter is ideal for those who are spending a limited time in Panama for specific reasons, who are not yet sure about relocation, and who still want to keep their options open.


The investment threshold and how it is satisfied


The real estate threshold and what counts toward it

The apartment or condo must have a value of at least $300,000. That's the main requirement as to the property itself. It can be located in any part of the country and can be of any kind without having to be pre-approved by the government. All it takes is to meet the minimum investment thresholds.

Even though Qualified Investor is achievable through a bank loan or developer financing structure, the lump sum of $300,000 must be paid up front, financing the remainder.






Pre-construction purchases: how the program treats a purchase agreement

The possibility of buying an apartment in pre-construction allows investors to acquire real estate of the highest quality for better prices and still be eligible. Decree No. 193 allows this in article 2.1, in which it stipulates the submission of a copy (authenticated by a notary) of the sales/purchase promise.

Secondly, applicants must submit the contract of the trust (it can be an authenticated copy), in which it must be stated that the total funds within the trust will be used for the payment of the property. 

Provision 2.2 refers to making the payment directly to the developer, paying 100% of the cost of the real estate that hasn't been built yet and, therefore, not yet registered in the Registro Público de Panamá (Panama’s Public Registry). 


Important considerations on acquiring pre-construction projects for the Qualified Investor Visa


  • Submit authenticated copy of the purchase and sale contract (2.1)
  • Submit trust agreement (original or authenticated copy) that establishes that the whole amount given to the trust will be used for the payment of the above-mentioned agreement (2.1)
  • Submit authenticated copy of the purchase and sale contract (2.2)
  • Bank guarantee in favor of the investor in which the developer promises to use the full amount of the investment for the acquisition of the real estate
  • Bank guarantee in favor of the investor, stating the developer’s responsibility for building the property and registering it in the public registry.
  • The bank guarantee must be presented annually to the Ministerio de Comercio e Industrias (the ministry responsible for driving commerce and promoting investment)
  • The guarantee can be executed by the investor if the developer doesn't comply with the construction timeline or doesn’t deliver



Financed purchases, joint ownership and holding structures

Following the above-mentioned framework, the applicant can thus finance part of the property as long as the full $300,000 is duly deposited. To obtain residency, they must prove the existence of the investment and that it’s under the applicant’s name or an entity in which the applicant is the final beneficial owner. 





What does not count toward the threshold?

The beauty of the program is that it doesn't have any restrictions when it comes to the property, except, of course, for the restrictions on foreign ownership which only apply within 10 kilometers of the international border. Buyers should also know that the first 22 meters from the high tide on the Pacific coast, and 10 meters on the Atlantic coast, are sold only by concession.

What Panamanian authorities and banks actually examine

Funds must come from abroad and from verifiable legal sources. The Servicio Nacional de Migración (Panama authority on migration matters) will examine whether the funds come from dividends, salary, or other sources. If it derives from the applicant's own company, they can verify that the company is in good standing and what types of activities it conducts.

 

Evidence that satisfies review, and evidence that generates questions

Bank account statements must match the declared income in order not to raise questions. Large sums of money without a clear path tracing back their origins (transactions, donations, payments, etcetera) can be a red flag.





The process step by step


Step 1: Power of attorney and preparing the application remotely

Most of the process is done remotely, that's why the interested parties must sign a power of attorney. Previous to this stage, the prospective resident will sit with his/her assigned Mundo expert and discuss the case together.


Step 2: document collection, apostille and translation

Once the individual has been pre-screened by the Mundo team, he/she starts to collect documents, and the team will apostille and translate if necessary.


Step 3: Filing with the National Migration Service and government fees

This part of the process can't be done remotely. It requires the physical presence of the applicant and dependents at Panama's Migration Service. Applicants appear in person with Mundo’s in-house lawyer, who is a licensed Panamanian attorney experienced in local legislation and particularly in residency.


Step 4: the in-country visit, biometrics, and what cannot be done remotely

From this moment on, the application follows its course in the hands of the authorities. Upon approval, the applicant must appear again in person, provide biometrics, take his/her picture, and receive the letter of approval and resident card. 


Step 5: Approval, residency card and the documents you receive

The resident card is issued at the moment you obtain the Qualified Investor Visa, and must be done in the presence of the resident. Hence, this stage of the process cannot be undertaken remotely.

It is important to understand that the migration process takes time and is subject to external factors. A realistic timeframe (providing that document collection is done fast and submission is not delayed) may last 6 months. Naturally, the Qualified Investor Visa aims at a specific niche, and it’s quite often issued faster.

The process requires a payment to the Tesoro Nacional (National Treasury) and another one to the National Migration Service, the latter having the objective of covering deportation expenses if ever needed.

Presence requirements and how residency is lost

While the minimum stay requirements are flexible and frequent-travel-friendly, total disconnection isn’t possible. Residents will have to visit the country for a few days every two years. If this is not complied with, the Panamanian authorities will demand an explanation for your absence. 

After four years of complete absence, they will ask for a considerable amount of documentation, and, eventually, they will proceed to revoke the resident status.





The path to citizenship: when it opens and what it requires

Foreigners who have lived for five years in Panama with permanent residency are eligible for citizenship through naturalization. It's important to note that this is not an investment citizenship. Instead, the status is granted through a traditional naturalization process according to what’s stipulated in Title XIII, Chapter II of the Panamanian Constitution. 

Among other things. it requires prior physical presence in the country, knowledge of Spanish, and passing an exam on Panamanian history, geography, and political structure.


Why applications get refused or delayed

It's vital to understand that the migration process is based on a prior process which depends on the visa specifications. This may be acquiring real estate, investing in securities, or establishing a legal entity. Sometimes the delay doesn't happen during the migration process per se, but in the previous steps. 


Mistakes in translations

A mistake in a translation, regardless of how small it may be, may lead to rejection or a revision petition. Even if those mistakes don’t alter the meaning of the text, they are not acceptable.


Misspelled names 

Translations with misspelled names, middle names, or surnames can lead to rejection or a petition by the Migration Office to amend the mistake. In many cases, this means preparing a whole new document/translation. Furthermore, these errors are not uncommon, especially when the languages are very different. Common errors are writing “Katerina” instead of “Ekaterina”, or Anastasia instead of “Anastasía”.

An issue with online systems may delay issuance of a document, certificate, or registry number, this is why it's so important to count on experienced experts. Hiring a licensed Panamanian attorney is mandatory, and applicants can find many. On the other hand, finding a professional who has both knowledge of the law and field experience is priceless. They can understand these nuances and overcome challenges better than anyone.


What residency does not change, particularly for US citizens

It is important not to follow aggressive marketing lines or “tax-free” advertisements. Panama is undoubtedly a friendly jurisdiction, and it brings several advantages in that regard. 

However, it is not entirely free of tax (because domestic properties and assets are taxed). Besides, each structure must be analyzed case by case. U.S. citizens, for example, can have Panama residency and even live here, yet they will still be taxable on their worldwide income in the US. Citizens of most countries will stop being taxed in their countries of origin if they cut all ties, although this must be consulted with a tax expert.
